1. Who we are

This website is operated by S&Y SAINI LIMITED (“Saini Living”, “we”, “us”), NZBN 9429048499491, New Zealand Companies Office number 8071464, registered at 2 Faber Place, Rototuna North, Hamilton, 3210, New Zealand. By accessing this website or placing an order you agree to these Terms.

2. Eligibility

You must be able to form a legally binding contract to purchase from us. We sell to most countries worldwide; where local law restricts the sale or import of an item, you are responsible for compliance.

3. Products & descriptions

Our products are decorative home goods sold as coordinated sets. We describe materials honestly (see our Acceptable Use & Safety page). Colours and natural materials may vary slightly from images due to screens, lighting and the nature of handmade or natural items. Dimensions are approximate.

4. Pricing & currency

All prices are shown in USD (US dollars). Prices exclude shipping and any applicable taxes or import duties, which are shown or determined at checkout. We may change prices at any time, but changes do not affect orders already accepted.

5. Orders & acceptance

Your order is an offer to buy. A contract forms only when we confirm acceptance of your order. We may decline or cancel an order (for example, where an item is unavailable, a pricing error has occurred, or we suspect fraud), and will refund any amount already charged.

6. Payment

Payments are processed securely by Stripe. We do not store your full card details. Your card or bank statement will show the descriptor “SAINI HOME”. By paying you authorise us to charge the total shown at checkout.

7. Shipping & delivery

Delivery is governed by our Shipping & Delivery Policy. Risk in the goods passes to you on delivery to the address you provide.

8. Returns & refunds

Returns, replacements and refunds are governed by our Refund & Returns Policy, which forms part of these Terms.

9. Your rights as a consumer (New Zealand)

Nothing in these Terms limits or excludes the guarantees, rights and remedies you may have under the New Zealand Consumer Guarantees Act 1993 or Fair Trading Act 1986 where they apply to you. Those statutory rights sit alongside these Terms and are not affected by them.

10. Acceptable use

Your use of this website is also subject to our Acceptable Use & Safety terms.

11. Intellectual property

All website content, imagery, text, designs and the Saini Living name are owned by us or our licensors and may not be copied or used without permission. Our patterns are original designs.

12. Limitation of liability

To the fullest extent permitted by law, and without limiting your statutory consumer rights, we are not liable for indirect or consequential loss, or for loss arising from improper installation or use of decorative items (see our safety disclaimer). Our total liability for any order is limited to the amount you paid for it.

13. Disclaimer of warranties

Except for guarantees that cannot be excluded by law, products are provided “as described”. Please read the safety, installation and material notes on the Acceptable Use & Safety page.

14. Force majeure

We are not liable for delays or failures caused by events beyond our reasonable control.

15. Governing law & jurisdiction

These Terms are governed by the laws of New Zealand, and the courts of New Zealand have non-exclusive jurisdiction, without affecting any mandatory consumer-protection rights in your country of residence.

16. Changes to these Terms

We may update these Terms from time to time. The version that applies to your order is the one published when you place it.
